as i type, the flood restoration people are drilling holes in my brand new kitchen cabinets to help them dry and keep from splitting. this sucks. it really really sucks. it sucks big giant donkey dicks. fuck fuck fuck.

just to fill you in, monday the lawn crew snapped off a water faucet on the outside of the house, but because of how the pipes were laid, it shot water INTO our house. straight into, you guessed it, our new kitchen.

i am sad. and i need a beer.

DAMN! that does suck. hopefully the contractor will be able to keep the damage to a minimum and save your cabinets. unless you just have to i wouldnt make an insurance claim. your rates will go through the roof.

we are officially on the lawn company's insurance tab. we won't have to make any claims through our own insurance comapny *whew*. but it is still a generally sucky situation!

But seriously... squeezle, please know that you have the absolute right to have your kitchen restored to same condition that it was before the damage occured even if that means installing brand new cabinets. So if you find the flood restoration people aren't doing the job properly or to your satisfaction (drilling holes?), don't allow the insurance company to dictate the manner in which the damage will be repaired because they usually try to take the cheapest way out.

It would be very hard to recover damages for trauma and inconvenience.

Under Intentional (or Reckless) Infliction of Emotional Distress, you must prove the lawn company's conduct was extreme and outrageous and was done with the intent to cause severe emotional distress. You should note that "extreme and outrageous" is defined as "conduct beyond all possible bounds of decency and regarded as atrocious and utterly intolerable in a civilized community."

And although there is NEGLIGENT Infliction of Emotional Distress (which may be easy to prove in your case), I don't believe this theory of law is recognized in Texas. But then again, I don't live or practice in Texas so I'm not 100% sure.

what always gets me in situations like that is that i find myself feeling guilty for whining about how nothing i have can ever stay nice, etc. it's like i feel like if i still have my health and stuff, i should treat any other crap like a luxury inconvenience -- and my dark and light sides start to battle.

remember that car wreck about a year or something age where the car got all totalled because that kid ran a red light? and the insurance company barely paid it off, let alone gave me anything extra? i felt guilty for being pissed because "at least we were all fine, etc..."

that's why crap like that is especially crazy-making for me, more than anything else. cause i get all conflicted and junk.

We had a terrrible, horrible, no good, very bad week and then got some news about Jack's sister and husband that is a personal tragedy and we're like,"Man, we're a couple of babywhiners."

It can always be worse, but at the same time you feel like you want to freak out or curl up in a ball at the unfairness life is dealing you.
